FY 2007 U.S. Advanced-Degree H1B Cap Reached

On July 28, 2006, USCIS announced that, as of July 26, it had received enough U.S. Advanced Degree H-1B petitions to meet the exemption limit of 20,000 established by Congress for fiscal year 2007. Petitions received on July 26, 2006 will be subject to a random selection process. Under this procedure, USCIS will identify those petitions received on July 26, and conduct a computer-generated random selection to allocate any remaining numbers. Petitions that are not selected or otherwise exempt from the cap will be rejected and returned along with the filing fee. USCIS will continue to process petitions for current H-1B workers that do not count towards the cap.
